In this paper, we critically interrogate the benefits of an interdisciplinary and theoretically diverse dialogue between ‘local food’ and ‘alternative food networks’ and outline how this dialogue might be enriched by a closer engagement with discourses of food sovereignty and the politics of scale. In arguing for a shift towards a greater emphasis on food sovereignty, we contend that contemporary discourses of food security are inadequate for the ongoing task of ensuring a just and sustainable economy of food. Further, rather (...) than treating the local and the global as ontologically given categories around which to contest the politics of food, it is our contention that recognising the socio-spatial aspects of the politics of scale has the potential to reinvigorate discourses of food security, food sovereignty and AFNs. Understanding scale as both fixed to a degree as well as contingent and dynamic has implications for an understanding of the role of food systems, for how the rescaled state privileges certain food systems and the possibilities for resistance through ‘jumping scale’ and food utopias. All of these aspects are significant if we are to fully comprehend and contest the challenges of envisioning and enacting real utopias of food sovereignty. (shrink)

Microbiologists are transitioning from the study and characterization of individual strains or species to the profiling of whole microbiomes and microbial ecology. Equipped with high-throughput methods for studying the taxonomic and functional characteristics of diverse samples, they are just beginning to encounter the conceptual, theoretical, and experimental problems of comparing taxonomy to function, and extracting useful measures from such comparisons. Although still unresolved, these problems are well studied in macro-ecology and are reiterated here as an historical precautionary for microbial ecologists. (...) Beyond expected and unresolved terminological vagueness, we argue that assessments and comparisons of taxonomic and functional profiles in micro-ecology suffer from theoretically unresolvable arbitrariness and ambiguities. We divide these into problems of scale, individuation, and commensurability. We argue that there is no technically/theoretically “correct” scale, individuation, or comparison of taxonomy and function, but there are nonetheless better and worse methodologies for profiling. We have, to some extent, a duty to help the needy—to meet their basic needs for food, water, shelter, and health care. Call this the duty of beneficence. Below, I argue that it is best understood as a duty both (a) to adopt helping the needy as “a serious, major, continually relevant, life-shaping end” (HILL 2002, 206) and (b) to never behave in a way (via act or omission) that’s factually incompatible with having such an end. (Behaving in a (...) given way is factually incompatible with having an end if and only if someone who knows all the relevant facts couldn’t behave in this way and still count as having this end—at least not if they have both all the other ends that they’re required to have and only those other ends that they’re permitted to have.) I call this the Kantian View, and I argue that it has several advantages over four of its rivals. In particular, I argue that it has the advantage of being able to account for all the following: (1) a diachronic (over-time) duty to take a sufficient number of favorable opportunities for helping the needy over the course of our lives, (2) a synchronic (at-a-time) duty to take every golden opportunity to help the needy that arises, and (3) the relationship between the two. Psychologists' emerging interest in spirituality and religion as well as the relevance of each phenomenon to issues of psychological importance requires an understanding of the fundamental characteristics of each construct. On the basis of both historical considerations and a limited but growing empirical literature, we caution against viewing spirituality and religiousness as incompatible and suggest that the common tendency to polarize the terms simply as individual vs. institutional or ′good′ vs. ′bad′ is not fruitful for future research. Also cautioning against (...) the use of restrictive, narrow definitions or overly broad definitions that can rob either construct of its distinctive characteristics, we propose a set of criteria that recognizes the constructs' conceptual similarities and dissimilarities. Rather than trying to force new and likely unsuccessful definitions, we offer these criteria as benchmarks for judging the value of existing definitions. (shrink)

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. Heinrichs (bio)In considering the specific issues raised by these three very thoughtful commentaries, it is helpful to reflect on the status of a theory or model for a specifically clinical discipline—what is it trying to accomplish and how might it proceed to do so? Kellert (2005) sees my proposal in terms of "borrowed knowledge"—the metaphorical application of a theory established in one field of (...) inquiry to another field—and views my application of chaos theory as a "nonliteral use of knowledge from the natural sciences" (p. 239). He likens it to attempts to explore consequences of relativity theory or quantum mechanics for areas other than those for which they were developed. He notes the rhetorical functions—including appeal to the disciplinary prestige of natural science—of such metaphorical borrowings.Although clearly there are significant metaphorical aspects at work here, there are at least two factors that distinguish this model from, say, the metaphorical application of quantum mechanics to a field other than subatomic physics. First, quantum mechanics purports to say something specific about the behavior of the subatomic world. Its development is wed to that specific content area. On the other hand, nonlinear dynamics, including chaos theory, is a formal mathematical model intending to characterize the behavior of any system of elements that possess certain formal relational properties. It does not start out as field or discipline specific. In fact it is not uniquely tied to the natural sciences at all, beyond the fact that it may be easier to obtain the sort of detailed repeated measures needed to demonstrate chaotic behavior in physical systems. So it is not just a question of whether chaos theory is a useful intuitive device for thinking freshly about clinical psychiatry. Rather, it is the quite literal and nonmetaphorical question as to whether some of the observable aspects of persons that are relevant to their psychiatric care behave chaotically, and if so what are the implications.Now it is quite true that direct, mathematically rigorous demonstrations of chaos in clinically relevant data sets is currently limited. In fact, one hoped for consequence of presenting this model is to encourage just such studies, and I suggest several promising directions for doing so. However, there are good reasons for thinking the presence of such chaotic behavior to be likely, and this relates to the notion of a clinical theory.One of the consequences of what Globus (2005) calls "triumphalist biological psychiatry" (p. 229) is the frequent assumption that the model or paradigm of psychiatry—an applied clinical practice, a techne—is synonymous with the paradigm of neuroscience—a basic science or episteme. This is clearly not so for many reasons, including the fact that the former has to incorporate the comprehensive treatment of discrete individuals in a way that the latter does not. Yet the respective theories are related more than metaphorically. [End Page 243] The paradigms of neuroscience and those of other relevant basic sciences, such as psychology, substantially inform the clinical paradigm and the clinical model must be at least compatible with those of the relevant basic sciences. Thus, it is reasonable to assume that if chaotic processes are demonstrable in the nervous system, for which significant evidence already exists, there is good reason to expect them to be reflected in clinically relevant domains. The clinical paradigm should make room for it and its consequences, rather than thinking within an outmoded neuroscience model that makes no room for the implications of nonlinear dynamics. And when this generates a picture more compatible than the old model with our usual sense of what it is to be human, the odds that we are on to something is further enhanced. Of course until such time that enough clinical research based on this model is completed, considerable speculation—indeed aided by metaphorical devices—is involved in generating a concrete sense of how the model would be applied to specific clinical problems, such as the treatment of depressed persons.One clear task of the clinical paradigm is the methodologic integration of interventions growing out of different informing basic sciences. Paper $16.95.The delightful, thought-provoking Abhidhamma Studies: Buddhist Explorations of Consciousness and Timeby the Venerable Nyanaponika Thera is the fourth incarnation of a text originally composed shortly after World War II, published in (...) 1949 (Frewin and Co., Ltd.). The Buddhist Publication Society issued a second, revised and enlarged edition in 1965 as well as a third edition, with relatively minor corrections, in 1976. The present edition, edited by Bhikkhu Bodhi, incorporates a variety of welcome changes, reflecting considerable effort and devotion to the task. In addition to authoring a superb introductory essay, Bodhi has "reformulated a few awkward sentences..., reorganized the notes, provided additional references, and supplied a bibliography" (p. viii). Perhaps the most intriguing and potentially significant change is evident in the title itself. Originally subtitled Researches in Buddhist Psychology, an apt but relatively uninformative description of its contents, the title now announces, even to the uninitiated, the book's unique, captivating subject matter: Buddhist Explorations of Consciousness and Time.This book is essential reading for any serious student of Buddhism. Additionally, it will appeal to those interested in a wide variety of both phenomenological and ontological issues: the manifold of experience, the nature of consciousness, the analysis of time, concepts of anattā(ego selflessness) and paticca-samuppāda(dependent origination), and so forth. An intermediate to advanced level of familiarity and understanding of basic Buddhist doctrines is recommended. It will prove particularly useful to scholars and students who have been intimidated by the vast, often cryptic, Abhidhamma literature.Apparently, the Buddha and his teachings were as enticing and yet profoundly puzzling and enigmatic to his contemporaries and followers as they remain to millions today. They challenge everything we commonly take to be real. That which appears substantial, we are told, is not. Contrary to our own (unexamined) inner/ subjective experience, as well as the teachings of most major world religions, we neither arenor havea self, for there is no self either to be or to have. The attempt to reconcile the teachings of the Buddha with existing beliefs and assumptions concerning the nature of reality led to a proliferation of competing philosophical schools. Each school developed its own distinctive Abhidhamma literature, ostensibly representing a deeper understanding of the teachings of the Buddha. BackgroundAlthough the number of reporting guidelines has grown rapidly, few have gone through an updating process. The STARD statement (Standards for Reporting Diagnostic Accuracy), published in 2003 to help improve the transparency and completeness of reporting of diagnostic accuracy studies, was recently updated in a systematic way. Here, we describe the steps taken and a justification for the changes made.ResultsA 4-member Project Team coordinated the updating process; a 14-member Steering Committee was regularly solicited by the Project Team when making critical (...) decisions. First, a review of the literature was performed to identify topics and items potentially relevant to the STARD updating process. After this, the 85 members of the STARD Group were invited to participate in two online surveys to identify items that needed to be modified, removed from, or added to the STARD checklist. Based on the results of the literature review process, 33 items were presented to the STARD Group in the online survey: 25 original items and 8 new items; 73 STARD Group members (86 %) completed the first survey, and 79 STARD Group members (93 %) completed the second survey.Then, an in-person consensus meeting was organized among the members of the Project Team and Steering Committee to develop a consensual draft version of STARD 2015. This version was piloted in three rounds among a total of 32 expert and non-expert users. Piloting mostly led to rewording of items. After this, the update was finalized. The updated STARD 2015 list now consists of 30 items. Compared to the previous version of STARD, three original items were each converted into two new items, four original items were incorporated into other items, and seven new items were added.ConclusionsAfter a systematic updating process, STARD 2015 provides an updated list of 30 essential items for reporting diagnostic accuracy studies. For the epic journey of autumn migration, long-distance migratory birds use innate and learned information and follow strict schedules imposed by genetic and epigenetic mechanisms, the details of which remain largely unknown. In addition, bird migration requires integrated action of different multisensory systems for learning and memory, and the hippocampus appears to be the integration center for this task. In previous studies we found that contrasting long-distance migratory flights differentially affected the morphological complexity of two types of hippocampus astrocytes. Recently, (...) a significant association was found between the latitude of the reproductive site and the size of the ADCYAP1 allele in long distance migratory birds. We tested for correlations between astrocyte morphological complexity, migratory distances, and size of the ADCYAP1 allele in three long-distance migrant species of shorebird and one non-migrant. Significant differences among species were found in the number and morphological complexity of the astrocytes, as well as in the size of the microsatellites of the ADCYAP1 gene. We found significant associations between the size of the ADCYAP1 microsatellites, the migratory distances, and the degree of morphological complexity of the astrocytes. We suggest that associations between astrocyte number and morphological complexity, ADCYAP1 microsatellite size, and migratory behavior may be part of the adaptive response to the migratory process of shorebirds. In ‘Can and Might’, Professor K. W. Rankin has presented three arguments that purport to refute the equivalence, ‘A is causally possible for P if and only if A is within P's power’. The first two arguments are attributed to Richard Taylor, and the third is Professor Rankin's own. I will argue that none of these three arguments effectively refutes the above equivalence. My arguments are not to be construed as simply a rebuttal of Professor Rankin's paper since he also (...) appears to have some doubts about Taylor's arguments and I refrain from comment on other aspects of his paper except these three arguments. O presente ensaio parte dos problemas enfrentados pela religião no âmbito do mundo moderno e sua particular compreensão de ciência. Pontualmente, ocupou-se em problematizar as querelas por ela enfrentadas quando a então embrionária modernidade estabelecia seus novos paradigmas científicos, motivando, portanto, o seu profundo deslocamento. Assevera-se, a partir daí, cada vez mais, uma inadequação da religião enquanto alvo a ser perspectivado pelo movimento científico nascente. A religião, portanto, não se viu pertencida aos debates produzidos pelo mundo moderno, nem tampouco pelo (...) cânone dos novos postulados científicos, representado, majoritariamente, pelo vertiginoso avanço das ciências da natureza. Discute-se, por isso, a partir de W. Dilthey, a emergência do paradigma das chamadas ciências humanas e daí a possibilidade de se entrever, novamente, a pergunta pela pertinência da religião, enquanto elemento fundamental da cultura humana e, portanto, indispensável à compreensão da humanidade do homem. Por fim, procurou-se convocar, no âmbito das chamadas ciências da religião, a dimensão hermenêutica das ciências humanas e a reabilitação da teologia enquanto campo imprescindível para a audição da religião. From time to time, the concerns on this matter were centered in the debates that involved religion, especially when the recently formed modernity established its new scientific paradigms, motivating, thus, its deep displacement. It was assured then, and ever more, an inadequacy of religion as a target to be reached by the rising scientific movement. Religion, therefore, has never been truly inserted in the debates produced by the modern world, not even by the canon of the new scientific statements, mostly represented by the rapid growth within sciences of nature. From Dilthey on, it has been argued the emergency of the so-called paradigm of the Human Sciences and then the possibility of foreseeing, again, the question on the pertinence of religion as a fundamental element of human culture which is, therefore, essential to the comprehension of the humanity of men. Finally, it will be evoked here, in the fields of the so-called Sciences of Religion, the hermeneutical dimension of the Human Sciences and the rehabilitation of theology as a primordial area to hearing religion. The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Upshot: Douglas Robinson argues for a revision of the extended mind theory that incorporates intersubjectivity and qualia. Robinson argues that “material extendedness” is less important than accounting for the subjective experience of what he terms “body-becoming-mind,” and that this experience, rather than mere computational equivalence between intra- and transcranial cognition, is the strongest argument in favour of the EMT.

In 1992, the United States Supreme Court, in Planned Parenthood of Southeastern Pennsylvania v. Casey, upheld the ruling in Roe v. Wade, namely that women have a right “to choose to have an abortion before viability and to obtain it without undue interference from the State.”1 However, since this ruling, some states have imposed regulations that greatly limit this right by restricting access. Texas is a recent example of this. Two proposed restrictions in House Bill 2, which will be discussed (...) in detail below, will force all but eight clinics that are located in metropolitan areas to shut down. The U.S. Supreme Court put the proposed restrictions on hold in October 2014, allowing several clinics to remain open while the restrictions are being appealed in the U.S. Court of Appeals for the Fifth Circuit. If the restrictions are passed, however, those clinics will be forced to shut down and, as a result, many women in Texas will be required to travel more than 100 miles in order to access a safe and legal abortion. Much of the focus of these restrictions has been on women and rightly so. However, I want to turn the attention to physicians. The requirements exacerbate unfair treatment of abortion providers compared with other physicians. Abortion providers face threats from the public—some of which turn into violent attacks—and they are often ostracized by their fellow medical practitioners. There are so few abortion providers to begin with and the proposed requirements limit these physicians’ opportunities to practice the branch of medicine of their choosing. Although the HB 2 requirements may not result in an unconstitutional undue burden on physicians, the challenges created by the bill limit physicians’ abilities to provide abortions. As a result of these limits, HB 2 creates an unconstitutional undue burden for women seeking abortions by creating barriers directed at abortion providers and clinic staff who are willing and able to provide abortions. The first of the two controversial HB 2 requirements is the admitting privileges requirement: “A physician performing or inducing an abortion must, on the date the abortion is performed or induced, have active admitting privileges at a hospital that is located not further than 30 miles from the location at which the abortion is performed or induced.”2 The second requirement is the ambulatory surgical center requirement: “The minimum standards for an abortion facility must be equivalent to the minimum standards adopted under [Texas Health & Safety Code] [...] for ambulatory surgical centres.”3 In order to meet these state-mandated obligations, some abortion clinics would have to spend more than $1 million in upgrades if they wish to remain open. The District Court decided that the ambulatory surgical center requirement places an unconstitutional undue burden on women, and that the two requirements together place an undue burden on women in Texas and especially in the Rio Grande Valley where the nearest clinic is a couple hundred miles away.4 Later, the U.S. Court of Appeals for the Fifth Circuit reversed the District Court’s decision and argued, “the admitting privileges requirement is constitutional on its face.”5 While the regulations are being appealed, the Supreme Court granted a stay of injunction, allowing about twelve abortion clinics to reopen until a final decision regarding the regulations is made. The District Court ruled that the purpose of the two regulations was to create a substantial obstacle for women seeking abortions in Texas. While the defendants argued that the regulations were designed to make abortions safer and reduce risk, the Court decided that this was not the case. An abortion, especially a first-term abortion, is a very safe procedure and is safer than many other routine surgical procedures. As stated in Planned Parenthood v. Casey, “Unnecessary health regulations that have the purpose or effect of presenting a substantial obstacle to a woman seeking an abortion impose an undue burden on the right.”6 The undue burden in this case is imposed, not through restricting women’s access directly, but by restricting physicians’ freedom to perform abortions. The admitting privileges requirement has reduced the number of physicians who can perform abortions and the ambulatory surgical center requirement has reduced the number of clinics where abortions can be performed. The American Medical Association states, “[t]he Principles of Medical Ethics of the AMA do not prohibit a physician from performing an abortion in accordance with good medical practice and under circumstances that do not violate the law.”7 This means that physicians are not required to perform abortions, except in emergency situations, but can as long as the procedure is done safely and does not violate the law. The new Texas regulations, however, are so restrictive that few abortion providers, limited to only four urban areas, can legally perform abortions. Physicians do not have an absolute right to perform abortions as opposed to women who have an absolute right to have access to an abortion. Physicians do face many challenges that other professionals face in terms of obtaining qualifications and finding work. Abortion providers, however, face challenges that most other physicians do not. The restrictions imposed by these regulations exacerbate unfair treatment toward abortion providers and place further obstacles in their path in terms of providing the service they want and are qualified to provide. Both abortion clinics and abortion providers are being treated differently from other medical clinics and physicians. For instance, “grandfathering of existing facilities and the granting of waivers from specific requirements is prohibited for abortion providers, although other types of ambulatory surgical facilities are frequently granted waivers or are grandfathered.”8 Many abortion clinics cannot afford the necessary upgrades. Furthermore, it is extremely expensive to open a brand new clinic that complies with the ambulatory surgical center requirements. Being grandfathered in would be the only option available to abortion clinics that cannot afford the upgrade. However, unfair treatment of abortion clinics and providers is preventing those clinics from being grandfathered into the new system. As a result, many abortion clinics may be forced to close. Admitting privileges are proving difficult or impossible for physicians both to obtain and, for those who have already been granted privileges, to keep. Dr. Sherwood Lynn, an obstetrician-gynecologist who has performed abortions for decades, describes the process of obtaining admitting privileges and the difficulties abortion providers face. After sending in an application a physician must wait for the hospital to send them the required materials, “but if the address of the practice on the application is of an abortion provider or clinic, [the hospital] won’t send [them] the package of materials required. [They] simply can’t apply.”9 Dr. Lynn and several other physicians have surmised that hospitals are only withholding privileges from qualified physicians who perform abortions and that other physicians do not face this discriminatory treatment. Hospitals have also revoked privileges granted to physicians after learning that the physicians perform abortions. For instance, in Texas two doctors, “received notices [...] informing them that their admitting privileges to the University General Hospital of Dallas have been revoked, with the hospital’s CEO claiming the hospital was unaware they were providing abortion care and that the hospital believed such care would damage its reputation.”10 What is curious about this revocation is that, “federal and state laws [...] forbid hospitals from discriminating against doctors who perform abortions,” and yet hospitals are clearly doing just that.11 Dr. Pamela Richter, another abortion provider in Texas, had her temporary admitting privileges revoked with no explanation and because of this, the clinic where she performed abortions, Reproductive Services, can no longer provide abortions at all.12 As the hospital gave no reason for the revocation, it not clear Dr. Richter’s privileges were revoked because she performs abortions. Dr. Richter, however, has performed over 17,000 abortions and her privileges were revoked soon after HB 2 was introduced.13 According to the Texas Hospital Association, giving admitting privileges to doctors who do not work for the hospital is expensive and time-consuming but this does not account for the fact that hospitals are revoking previously granted privileges from physicians whom they learn are providing abortion services.14 As mentioned previously, the District Court found that the admitting privileges requirement and the ambulatory surgical center requirement do not further ensure the health and safety of women undergoing an abortion. Several physicians have testified to this fact. Dr. Lynn stated in an interview: The admitting privileges requirements are [...] absolutely unnecessary. If you have a number of patients waiting for procedures, and something happens and a patient needs to be transferred to a hospital, you’re not going to leave everyone else and go to the hospital. That makes no sense. You’re going to refer that person to a gynecologist at the hospital. There is no safety issue involved here. If a patient shows up with an emergency, every hospital is required to admit that patient. They have to by law.15 It is rare that complications will arise from an abortion performed in a clinic. Dr. Richter, for example, has performed more than 17,000 abortions and not once had to send a patient to a hospital because of complications resulting from the procedure. According to Dr. Lynn even if abortion providers were granted privileges to hospitals, it is unlikely that they will exercise them. In essence, having admitting privileges at a hospital does nothing to further ensure the safety of an already safe procedure. The only result of the admitting privileges requirement is to limit certain physicians’ ability to perform legal abortions. Not only do the HB 2 requirements fail to further ensure the health and safety of women, the HB 2 requirements may actually create more health risks to women who cannot access the eight remaining clinics. The first risk is that the remaining clinics would have an influx of patients that they may not be able to handle, forcing women to wait longer for an appointment. As stated by the District Court, “[e]ven assuming every woman in Texas who wants an abortion [...] could travel to one of the four metropolitan areas where abortions will still be available, the cumulative results of HB 2 are that, at most, eight providers would have to handle the abortion demand of the entire state.”16 Furthermore, “[t]hat the State suggests that these seven or eight providers could meet the demand of the entire state stretches credulity.”17 Abortion is a time sensitive procedure. It is safest when performed early in a pregnancy. The increase in patients to these remaining clinics, assuming all women in Texas can access them, will increase wait times and may force women to have abortions later in pregnancy. In the worst-case scenario, a woman would not see an abortion provider at all before viability. Such instances may be rare, but they are possible. In such cases, women’s access to legal abortions becomes impossible and thereby violate the ruling in Roe. Clinics may be able to avoid the aforementioned problems if they hire more physicians. However, there are two barriers to hiring more physicians. First, as mentioned previously, admitting privileges to Texas hospitals are difficult, if not impossible, for abortion providers to obtain. Second, given the negative treatment of abortion providers by anti-abortion groups, many physicians are not willing to perform abortions. The harassment abortion providers face is unique to those physicians and many physicians will not perform abortions for that reason. In an article published in the Austin Chronicle, anti- abortion activist Abby Johnson, “discusses how her group investigated appraisal district records to find the new location of where an Austin abortion physician plans to work.”18 Johnson states, “These abortionists are feeling the pressure from the pro-life movement in Texas. I think they feel like they’re on the run. And that’s how we want to keep it.”19 If the HB 2 requirements are passed and there remain at most eight abortion providers in Texas, these activists will concentrate on those clinics and, “the dangerous impact of their intimidation tactics will be exacerbated.”20 Even if the number of physicians needed to meet the demand in Texas can obtain admitting privileges and work at one of the remaining clinics, they may choose not to do such work because they are putting themselves at risk. The harm abortion providers face from such anti-abortion groups is not unique to Texas. There are stories from all over the country and from other countries where abortion is legal of physicians receiving death threats. Dr. George Tiller, an abortion provider in Kansas, was killed outside his church and had received numerous death threats prior to this. The HB 2 requirements are making it so that abortion providers either cannot provide their services any longer or will face increased threats and increased danger to themselves. Physicians are allowed to conscientiously object to providing medical interventions in certain circumstances for moral and religious reasons. However, there are limits on this right. According to the American Congress of Obstetricians and Gynecologists, “[w]hen conscientious refusals conflict with moral obligations that are central to the ethical practice of medicine, ethical care requires that the physician provide care despite reservations or that there be resources in place to allow the patient to gain access to care in the presence of conscientious refusal.”21 I would argue fear for one’s safety in the face of immediate threats is perhaps a stronger ground on which to refuse to provide care than a personal belief that abortion is immoral or against one’s religion. ACOG also states, “[p]roviders with moral or religious objections should either practice in proximity to individuals who do not share their views or ensure that referral processes are in place so that patients have access to the service that the physician does not wish to provide.”22 This responsibility has been largely disputed by the medical community but in cases of rape, incest, and health risks to women, referrals must be made without exception. However, under the requirements of HB 2, working in proximity to an abortion provider may not be possible because they are so geographically limited. Referrals are supposed to be made within reason. Some areas of Texas, such as the Rio Grande Valley, are up to 200 miles away from the nearest clinic that would remain open if HB 2 is passed. Referrals may simply not be feasible given the geographical distances and the decreasing number of available physicians. As mentioned above, there are two risks to the health and safety of women as a result of HB 2. The second of these is that if a woman cannot access one of the remaining clinics, she may seek out a more convenient but illegal and unsafe abortion, which is far more likely to result in a dangerous complication. Dr. Lynn states, “[b]ecause of the restrictions lawmakers impose, women will seek abortions illegally, and we’re going to see a rise in septic abortions.”23 Some areas of Texas might effectively revert back to a pre-Roe era where abortions were performed in unsanitary conditions by unqualified people resulting in dangerous medical complications far more often than legal abortion procedures do now. Physicians like Dr. Lynn who want to prevent this from happening generally cannot do so without facing legal sanction. Physicians have a duty to provide safe medical care and if they cannot obtain admitting privileges, they cannot exercise this duty. ACOG released a statement expressing their objections to the new requirements. They state that HB 2 is, “plainly intended to restrict the reproductive rights of women in Texas through a series of requirements that improperly regulate medical practice and interfere with the patient-physician relationship.”24 Executive Vice-President of ACOG, Hal C. Lawrence III stated: The Texas bills set a dangerous precedent of a legislature telling doctors how to practice medicine and how to care for individual patients. ACOG opposes legislative interference, and strongly believes that decisions about medical care must be based on scientific evidence and made by licensed medical professionals, not the state or federal government.25 Abortion is one of only a few areas of medicine where the legislature imposes so many regulations restricting particular physicians’ ability to practice medicine. Not only are abortions providers being regulated by the state, they are also facing clear discrimination from others within the medical community. The state is closing down clinics that do not meet the ambulatory surgical center requirements and hospitals are denying physicians admitting privileges because they perform abortions. In summary, abortion providers are being discriminated against both by the legislature and other members of the medical community. Other physicians who do not perform abortions are not denied admitting privileges on discriminatory grounds. Clinics that cannot afford upgrades to become an ambulatory surgical center are being grandfathered in, while abortion clinics are being forced to close down. Ob-Gyns who conscientiously object to performing abortions and who are not located in close proximity to at least one abortion provider cannot effectively fulfill their duty to refer patients. Lastly, given the barriers these regulations will create, there will likely be a rise in complications resulting from abortions provided under grossly unsafe conditions. Physicians, whose duty it is to provide safe and effective medical care, are being denied the right to exercise this duty. While this denial may not be unconstitutional, it is certainly unjust and discriminatory and creates obstacles that other physicians do not face. Most importantly, these obstacles are creating an undue burden for women. The HB 2 requirements do not increase the health and safety of abortions; all they do is create substantial obstacles for women. In light of these observations, the requirements seem to me to be in clear violation of Casey, in which it was decided that, “[u]nnecessary health regulations that have the purpose or effect of presenting a substantial obstacle to a woman seeking an abortion impose an undue burden on that right.”26 These regulations do just what Casey was meant to prohibit and this is accomplished through limiting physicians’ ability to practice safe abortions across the state of Texas. Thomas underscores what Outka calls the " inclusive " conception of universal love. God is to be loved as the supreme good, as the source of all happiness; the neighbor is loved as sharing in the happiness we receive from God. Charity eviscerates (...) neither our natural inclination for happiness nor our natural associations with others. Rather, it " commands each act of other sorts of friendship " in relation to our friendship with God. Charity is inherently prudential and thus an account of " special relations,'' which Werpehowski and others address, is incorporated into the discussion of charity. Of course one might make the same objection against Thomas's appropriation of Aristotle that I have leveled against the appropriation of modern notions. But Aristotle is not so much a secular rival of Christianity as he is a philosopher of human nature. A return to Christian Aristotelianism is suggested by Kierkegaard's dictum that we have forgotten what it means to be Christian because we have forgotten what it means to be human. THOMAS s. Studien und Texte zur Geistesgeschichte des Mittelalters 33. Leiden/New York: Brill, 1992. Pp. vi + 131. $40 (cloth). Aquinas's expositio of the De Trinitate of Boethius is an admirable paradigm of profound analysis and interpretive genius. Adhering closely to a literal reading of the short sexpartite Boethian tractate, but breaking off his analysis (for reasons unknown) just before the end of section two where Boethius begins his ex professo treatment of the Trinity, Aquinas ends up mainly plumbing the depth of Boethius's prefatory remarks about the epistemological status of theology, and thus in six questions (comprising 24 articles) constructs the most extensive treatment in all his works of the nature and method of theology. Little wonder, then, that Leo Elders titles his introduction to the expositio of Aquinas Faith and Science (Rome, 1974) or that Armand Maurer names his two volume translation of it Faith, Reason and Theology and The Division and Methods of the Sciences (Toronto, 198687 ). In Thomas's commentary, only the fourth article of question three treats the doctrine of the Trinity directly, though the four articles of BOOK REVIEWS 319 question four also discuss the cause of plurality, a crucial topic for trinitarian theology. I was mildly surprised, then, that Douglas Hall gives the title The Trinity to what professes to offer a " careful textual analysis and criticism " (112) of the methods and contents of Aquinas's commentary. In this slender book of four chapters, Hall inserts, between a short introduction and a conclusion, a second chapter on all five of Boethius's tractates and a third on Aquinas's commentary on the De Trinitate. He has some interesting things to say about the dating and contents of the Boethian works, and also makes some good points about Thomas's commentary, especially as regards questions five and six. But the title is a misnomer, for Hall skips over lightly the five articles mentioned above where Aquinas treats trinitarian issues, devoting only three pages to them. Hall's main concern, like Aquinas's, is theological methodology and epistemology. Hall attempts a rather Hegelian, dialectical appraisal of Aquinaswhich stresses Aquinas's reconstruction of Boethius by highlighting their common methodological theme of agnosia-and links it with an integrative approach which grounds itself in " a transcendental reading of Aquinas, while retaining themes from participationist and analogical literature" (112). The first chapter discusses the participationist, analogical, and transcendental strains of contemporary Thomism, and evinces a certain predilection for Rahner (his influence is also evident on pages 50, 58, 92-95). In sum, Hall combines a Rahnerian and dialectical reading of Aquinas. Due to his presupposition, however, he frequently does not engage Aquinas on his own grounds but burdens him with false problems and dubious theses as he seeks to sort out Aquinas's " dialectical tensions." Old philosophical problems never die, but they can be reinterpreted. In this paper, I offer a reinterpretation of the problem of reconciling divine omniscience and human free will. Classical discussions of this problem concentrate on the nature of God and the concept of free will. The present discussion will focus attention on the concept of knowledge, drawing on developments in epistemology that resulted from the posing of a certain problem by Edmund Gettier in 1963.

I. Beyond Utilitarianism In the summer of 1982, I published an article called “Missiles and Morals,” in which I argued on utilitarian grounds that nuclear deterrence in its present form is not morally justifiable. The argument of “Missiles and Morals” compared the most likely sort of nuclear war to develop under nuclear deterrence with the most likely sort of nuclear war to develop under American unilateral nuclear disaramament. For a variety of reasons, I claimed diat the number of casualties in (...) a two-sided nuclear war developing under DET would be at least fifteen times greater than the number of casualties in a one-sided nuclear attack developing under UND. If one assumes that human lives lost or saved is the principal criterion by which nuclear weapons policies should be measured, it follows that DET is morally superior to UND on utilitarian grounds only if the chance of a two-sided nuclear war under DET is more than fifteen times less dian the chance of a one-sided nuclear attack under UND. Since I did not believe that the chance of nuclear war under deterrence is fifteen times less than the chance of nuclear war under unilateral nuclear disarmament, I inferred diat utilitaranism failed to justify DET. Indeed, on utilitarian grounds, DET stood condemned. (shrink)

A growing interest in and concern about the adequacy and fairness of modern peer-review practices in publication and funding are apparent across a wide range of scientific disciplines. Although questions about reliability, accountability, reviewer bias, and competence have been raised, there has been very little direct research on these variables.The present investigation was an attempt to study the peer-review process directly, in the natural setting of actual journal referee evaluations of submitted manuscripts. As test materials we selected 12 already published (...) research articles by investigators from prestigious and highly productive American psychology departments, one article from each of 12 highly regarded and widely read American psychology journals with high rejection rates (80%) and nonblind refereeing practices.With fictitious names and institutions substituted for the original ones (e.g., Tri-Valley Center for Human Potential), the altered manuscripts were formally resubmitted to the journals that had originally refereed and published them 18 to 32 months earlier. Of the sample of 38 editors and reviewers, only three (8%) detected the resubmissions. This result allowed nine of the 12 articles to continue through the review process to receive an actual evaluation: eight of the nine were rejected. Sixteen of the 18 referees (89%) recommended against publication and the editors concurred. The grounds for rejection were in many cases described as “serious methodological flaws.” A number of possible interpretations of these data are reviewed and evaluated. (shrink)

Erich Frank is chiefly known for two works. In Plato und die sogenannten Pythagoreer, 1923, Frank published the results of research to determine who the Pythagoreans actually were and what part they played in Plato's conception of nature. In 1945 he published Philosophical Understanding and Religious Truth. It had been the hope of his friends that Frank would present a more comprehensive and systematic exposition of his thought. Frank's sudden death in 1948 put an end to this hope. In Knowledge, (...) Will and Belief Ludwig Edelstein has collected together twenty of Frank's papers and has appended an account of Frank's life and work. Until 1939 Frank was professor at Marburg. After that he was attached to universities in the United States. Half of the papers in this collection are in English, the others are in German. Readers in the English speaking world will find Frank's German quite readable. Half of the papers have not hitherto been published; of those which have been, many are hidden in unfamiliar journals. Moral foundations theory (MFT) proposes the existence of innate psychological systems, which would have been subjected to selective forces over the course of evolution. One approach for evaluating MFT, therefore, is to consider the proposed psychological foundations in relation to the reconstructed Environment of Evolutionary Adaptedness. This study draws upon ethnographic data on nomadic forager societies to evaluate MFT. Moral foundations theory receives support only regarding the Caring/harm and Fairness/cheating foundations but not regarding the proposed Loyalty/betrayal and Authority/subversion foundations. These (...) latter two proposed foundations would seem to reflect the historical classic assumptions of modernity, involving self-interest, competition, individualism, hierarchy, authority and so forth. Studying the ethical dimensions of nomadic forager societies can highlight our biases about the foundations of morality, some of which may be steeped in particularist Western political and social traditions. Some recent developments from cosmopolitanism are discussed as an alternative evolving worldview that parallels nomadic forager ethos. (shrink)

Nursing research in China is at an early stage of development and little is known about the practices of Chinese nurse researchers. This interview study carried out at a university in central China explores the informed consent practices of Chinese nurse researchers and the cultural considerations of using a western technique. Nine semistructured interviews were conducted in English with assistance and simultaneous translation from a Chinese nurse with research experience. The interviews were analyzed by one western and two Chinese researchers (...) and major themes were identified. All participants endorsed informed consent as ethically required. Differences were noted between some of the informed consent practices typically recommended in the USA and those identified in this study, such as: recruitment using local and government officials, recruiting directly from medical records without special permission, family consultation in consent and consent control, and not revealing randomization to intervention groups receiving different treatments.
